You will find on the next pages the general conditions of sale (hereinafter referred to as "CGV") for registration and orders on the online shop of Mr. Laurent BROGNEAUX on the website www.malampe.be (hereinafter " Malampe.be ").
In particular, the legislator requires online service providers to include numerous indications concerning the contract and the applicable conditions. Below, we have gathered for you these indications and other conditions of delivery.

1. Scope - Time limits

1.1. The order and the delivery are carried out exclusively in accordance with the present Terms and Conditions, which base all the contracts concluded on the basis of the offers present on Malampe.be.

1.2. When it comes to "consumers" in the present GTC, they are natural persons, who conclude a legal act for reasons that are mainly foreign to their professional or independent activities.

"Entrepreneurs", on the other hand, are individuals or corporations, or companies with legal personality, who command for the purposes of their commercial, independent or liberal activity. Both consumers and businesses are considered as customers within the meaning of these Terms and Conditions.

1.3. If working days are indicated as deadlines, these include all days of the week except Saturdays, Sundays and statutory holidays.

2. Registration on Malampe.be

2.1. When ordering merchandise and / or opening a customer account on Malampe.be, you will be prompted to register and provide your personal information.

2.2. When registering, you are responsible for the correctness and completeness of the information to be provided. You agree to treat the access data confidentially and not assign it to any unauthorized third party. Confirmation of registration takes place immediately after sending it.

2.3. You are solely responsible for the contents of its accessible areas. They may not infringe the rights of third parties. There is no right to publish and archive content, such as product evaluations.

2.4. You must refrain from any malfunction of the site Malampe.be or generally any use of data accessible outside the intended use inside the platform. The manipulations carried out with the aim of obtaining undue payments or any other advantage harmful to the interests of Malampe.be or of any other party involved may, apart from the legal consequences, more particularly result in the loss of access to Malampe.be. 3. Ordering process - Possibility of modification - Possibility of memorization and consultation of the text of the contract

3.1. We have shaped the technical control process in a very simple way. Choose from the offers on Malampe.be an item and determine the quantity required for each item ordered. You prepare the order for the selected item by clicking on the "Add to cart" button. With the "Continue Shopping" button, you return to the catalog and you can select other items and add them to the shopping cart. To continue the order, click on the "Add to cart" button.

3.2. In the shopping cart you can check the quantity of selected items again, correct or delete certain items or add new items using the "Continue Shopping" button. Click "Place Order" to access your existing registration or to register your data. You may (i) enter another delivery address, (ii) be invited to accept the general conditions of sale, legal right of revocation and current data protection statements, (iii) may choose your method of payment and (Iv) may, before sending your order, calmly verify the indications and possibly correct them. The completed command can already be saved and printed. By clicking on the "Buy" button, the order is legally concluded.

3.3. You can consult these Terms and Conditions at www.malampe.be under the heading "CGV". You can also print and save this document using the usual function of your browser type and save them in PDF format.

3.4. The text of the contract will be registered but can not be consulted separately afterwards. The contract text can however be printed or saved before sending. You can also archive the data of your order by (i) downloading the GTS and saving with the help of your browser the data on the last page of the order or (ii) pending the automatic confirmation of the order as well as The automatic confirmation of the contract, which will be transmitted by e-mail to your address after the closing of the order. These emails contain once again the order data and can easily be printed or, thanks to your e-mail program, saved.

3.5. Your order data are registered with us, but, for security reasons, can not be directly consulted by you. We offer for each client a direct password-protected access to your order data ("customer account"), which you can access via the "Login" button. Here, after registration, you will be able to manage and save your data regarding previous orders, addresses, payment terms and a possible subscription to a newsletter.

4. Payments - Deadlines

4.1. In principle, the payment methods Prepayment, credit cards, Mr. Cash and PayPal are at your disposal. Malampe.be nevertheless retains the right to each order, not to propose certain modes or to refer to another method of payment. A right to a particular method of payment does not exist.

4.2. When choosing the Prepayment payment method, the purchase price is due immediately. Transaction data is delivered to you upon receipt of your order. By choosing the Prepayment payment method, we will give you a 3% discount on the purchase price. Delivery times count upon receipt of payment. During the Prepayment payment mode, the availability of the selected item can be modified according to the time of payment.

4.3. By using a credit card (Visa, MasterCard or other cards), a reservation (pre-authorized) is made at the time of execution of the order. Your credit card is debited at the time of shipment, but no later than fourteen (14) days after completion of the order.

4.4. The purchase price is payable on the invoice at the end of the fourteen (14) day payment deadline after the delivery deadline specified in the offer (thirty (30) days). Please note that the deadline can be determined according to the timetable and that after the expiry of the deadline, you are required to give notice without warning. However, we remain responsible for general inquiries from customers (eg merchandise, delivery time, shipment), returns, claims, revocation requests or claims.

4.6. PayPal (Europe) S.à rl & Cie, SCA, 5th Floor, 22-24 Boulevard Royal, 2449 Luxembourg (If you decide to pay via PayPal or PayPal Express, you pay the invoice amount by PayPal Hereinafter "PayPal"). You must be registered with PayPal or register in advance. During the order process, you are directed to the PayPal website and you can identify yourself by entering the access data and confirm the payment order. The purchase price is due immediately. With PayPal-Express, we make your life even easier. After choosing the payment method, you no longer have to enter your data, since the address data registered with PayPal, which you can confirm before the payment transaction, will be used and transferred to us.

4.7. Please note that we only accept payments from accounts within the European Union (EU). Under no circumstances will we accept the costs of a money transaction.

4.8. Malampe.be reserves the right to send invoices only electronically (currently via e-mail).

5. Language - Conclusion of contract

5.1. Contracts relating to articles, offered for sale on Malampe.be, are exclusively concluded in French.

5.2. The presentation of the products on our online shop does not represent a legally binding offer but a catalog online without commitment. By clicking on the "Buy" button, you send a firm offer to purchase items in the basket.

5.3. The confirmation of the technical receipt of your order comes immediately after receipt of the order via e-mail to the address filed by you. This confirmation of receipt does not yet constitute acceptance of your order.

5.4. A legally binding contract for the purchase of items ordered by you is born when the order is accepted. Acceptance can be effected in different ways: The customer's order (i) is accepted by a separate declaration by e-mail, (ii) the customer is asked to pay during the Prepayment payment method, or (iii) the customer Chooses an offer and pays via PayPal. If the customer chooses the payment by credit card, the contract is concluded upon delivery of the goods.

6. Prices - Shipping costs - Additional services

6.1. The current prices are the current prices at the time of the order. The prices mentioned include the amount of the ordered part, the T.V.A applicable in Belgium and the additional costs.

6.2. The shipping costs for any delivery within and outside Belgium are the responsibility of the buyer. Our deliveries will in principle be made on working days between 7 and 18h.

6.2. Additional fee-based services (eg Saturday delivery, late deliveries between 18:00 and 20:00 and delivery with an afternoon / afternoon time slot) are for certain items (only if delivered by a Specialized transport) and may be added after telephone notification.

7. Availability - Supply risk - Suppression of delivery obligation - Extension of delivery times - Delay - Delivery areae.be

7.1. Many items on Malampe.be are available in stock, although the quantity in reserve is limited due to the variety of items. If, as a company, you wish to place a larger order, please contact us in advance to check availability.

7.2. We do not assume the supply risk. We are solely responsible for the delivery of goods in stock and ordered from our suppliers.

7.3. Malampe.be reserves the right to withdraw from the contract if Malampe.be is not itself properly and in a timely manner and that the missing availability can not be justified, that you have been informed without delay and that the risk of Supply was not assumed. In case of unavailability of the goods, any payment in advance is reimbursed without delay.

7.4. Delivery times are reasonably prolonged in cases of force majeure. Strikes, lock-outs, administrative measures, shortages of energy and raw materials, transport bottlenecks, operational difficulties due to accidents, etc., are considered as cases of force majeure. ex. Fire, water and mechanical damage, and any other disturbance of which we are not objectively responsible. Beginning and end of such circumstances will be communicated to you without delay. If the aforementioned disturbance lasts more than four (4) weeks after the initial delivery deadlines, you are entitled to terminate the contract. Any claim, including the right to damages, is excluded.

7.5. For consumers, the risk of accidental disappearance or fortuitous deterioration of the goods sold passes to the buyer at the time of delivery of the goods to the consumer or to a consignee designated by him. This provision shall apply whether the consignment is insured or not. The transfer or receipt is not affected by the delay of receipt by the buyer. Otherwise, the risk passes to the customer during the transfer, delivery or shipment of the goods to the shipper, the valet or any other person responsible for carrying out the shipment.

7.6. If it has been agreed that the customer specifies more of his order with Malampe.be concerning dimensions, design or model and the customer does not respect the deadline for doing so, the resulting delay can not be attributed to Malampe.be. Malampe.be reserves the right to cancel all or part of the unspecified order in time.

7.7. The delivery is exclusively in Belgium.

8. Legal right of withdrawal for consumers

The consumer has, under the conditions specified below, a right of withdrawal.

Right to retract

You have the right to cancel the contract within fourteen (14) working days without giving reasons.

The withdrawal period runs from the day on which you or a third party other than the carrier, designated by the consumer, physically takes possession of the property (s) purchased.
To exercise your right of withdrawal, you must inform us, Malampe.be: 114, Rue Lileutige at 4140 Sprimont - inf@malampe.be, by means of an unequivocal declaration, (eg by post, fax or e-mail -mail) as to your intention to revoke this contract. For this purpose, you can use the ad hoc form you find here.

In order to respect the withdrawal period, it is sufficient to send the declaration before the expiry of the said period.

Consequences of withdrawal

If you cancel the contract, we must reimburse you promptly and no later than fourteen (14) working days, upon receipt of the returned merchandise or proof of delivery, of any monies received , Delivery costs included (excluding additional shipping charges due to the choice of another method of delivery).

For the reimbursement, we use the same means of payment as for the initial transaction, unless otherwise agreed. Under no circumstances will we charge additional costs for this refund.

You must return or return the goods to us without delay and no later than fourteen (14) working days from the day you inform us of the withdrawal statement. The delay is respected if you return the goods before the deadline of fourteen (14) working days.

We do not pay the costs of returning the goods, they are at the expense of the buyer. Your liability is only in respect of the depreciation of goods resulting from manipulations other than those necessary to ensure the nature and proper functioning of these goods.

Exclusion or even extinction of the right of withdrawal

The right does not apply to contracts for the supply of goods which had to be manufactured according to the client's specifications or clearly adapted to your personal needs.

9. Reservation of title

The ownership of the goods sold is reserved to Malampe.be until full payment of the sale price.

11. Warranty

For material defects and defects of law, Malampe.be is responsible under the applicable legal provisions.

12. Governing law and jurisdiction

12.1. For any transaction or other legal relationship, Belgian law is applicable.

12.2. In case of dispute, only the courts and tribunals of the judicial district of Liège (Belgium) are competent.

13. Safeguard clause

If one or more clauses of this contract or parts thereof are invalid or incomplete, the validity of the other clauses shall not be affected. The respective legal status takes the place of the invalid or missing provision.
